The relevance of the study lies in the fact that in the reforms of the system of compulsory enforcement of decisions stipulated the possibility of performing these functions by private enforcers. The purpose of the article is to consider problematic aspects of the legal status of a private enforcer as a participant of legal relations in the enforcement process. The results of the study contain generalizations on the analysis of the legal status of a private enforcer, proposals for amendments to (...) current legislation on private enforcers and the protection of the rights of the parties of enforcement proceedings. Finally, conclusions were formulated, which may be useful to practitioners of various legal professions such private enforcers, lawyers, judges, as well as citizens and legal persons, including those who are parties to the executive procedure. In this paper is constructed an analogue of the square of opposition for propositions about relations between two non-empty sets. Unlike the classical square of opposition, the proposed scheme uses all logically possible syllogistic constants, formulated in V.I. Markin’s universal language for traditional positive syllogistic theories. This scheme can be called “Logical lantern”. The basic constants of this language are representing the five basic relations between two non-empty sets: equity, strict inclusion, reversed strict inclusion, intersection and exclusion (considered are only (...) the relations between sets, but not the relations of the sets to the universe). The other relations between sets are combinations (disjunctions) of the basic ones. There are 32 constants and 32 respective propositions, and the proposed diagram expresses and/or allows to deduce the logical relations among those propositions. The constructed scheme, making it possible to visually see the logical relations among propositions about relations between two non-empty sets, allows us to suggest considering logical relations not discussed previously: many-place Aristotelian-like logical relations among propositions: exhaustive _n_-place contrariety and exhaustive _n_-place subcontrariety (_n_ is a natural number, \(n>2\) ). The article reveals the approaches to the essence of man by one of the founders of Russian cosmism K.E. Tsiolkovsky and V.I. Vernadsky. the teaching of which is attributed to the natural-scientific direction of Russian cosmism, during the emergence of the vector of technical and technological development of mankind. The idea of a holistic, harmonious approach to the material and spiritual world of man united the philosophical worldview of K.E. Tsiolkovsky and V.I. Vernadsky, who viewed man and the surrounding world (...) in unity from an objective standpoint, and the mind was the source of man's conquest of the Universe. The approaches of K.E. Tsiolkovsky and V.I. Vernadsky have much in common and are characterized by the scale of views on man as a global and cosmic being. At the same time, two great cosmologists approached their conclusions from different research positions. Each of them has his own way of philosophical view of a person and the world around him. The article provides a comparative analysis of the teachings of K.E. Tsiolkovsky and V.I. Vernadsky, analyzes the general and different. The relevance of the topic is determined by the modern problems of the biosphere, which as a global system has already lost its stability under human influence. A more in-depth study of the philosophy of K.E. Tsiolkovsky and V.I. Vernadsky allows us to trace the relationship of their peculiar ideas with global approaches to the microcosm of man, understanding the transcendental and spiritual foundations of the philosophy of cosmism. The article considers the issue of chnging the main anthropic characteristics of a human under the influence of the rapid development of the latest technologies. Such changes cause the need to revise the usual interpretation of the concept of ‘human’, which is gradually being substituted by the currently popular concepts of ‘trans-’ and ‘post-human’. These concepts are favourably perceived by the techno-optimists, who believe that the latest technologies will allow us to create people who will be physically, intellectually and spiritually (...) superior to the people of today, although they admit that this may lead to greater social inequality. The article states that the post-human potential is too ambiguous to clearly outline it. On the one hand, it opens up unprecedented possibilities, which can be considered the highest manifestation of human freedom, i.e. the ability to model a person according to one’s vision. On the other – there is a real threat to human existence itself, namely, the danger of technological capture of the potential for human improvement. Therefore, the task of the article is to outline the possible prospects for the formation and improvement of modern human identity under the conditions of its combination with the other, non-human species and the latest technologies. This is possible under the condition of acceptance of new possibilities for the post-human as the liberating force that overcomes the negativity and limitations of human nature. This article considers the ethical dimension of technological science (technoscience), namely, the problem of the applicability of the categories of ‘good’ and ‘evil’ to the functioning of new technologies. Aspects of evil brought about by the introduction of new technologies (i.e. lack/scarcity of resources, devaluation of human labour, ignorance of/inability to use technical tools, violations of the measure and harmony of life, etc.) are highlighted. Particular attention is paid to a new form of evil, namely artificial/technological evil. The article argues (...) that the emergence of such evils is associated with the growing scale of human intervention in the natural course of things and with recent advances in technology. Dangers related to the uncontrolled development of technological science along many axes of human existence are analysed. The authors conclude that overcoming artificial evil is possible via a transition from a man-made to an anthropogenic (intellectual and humanistic) form of civilisation in which the achievements of technoscience serve not the self-destruction of mankind but the discovery of essential human forces. The article is dedicated to analyzing the nature of genius in the context of the development of fiction about artists. From the biographies of the famous Renaissance artists by G. Vasari, who made one of the first attempts at chronicling the lives of geniuses of his time, to modern fictionalized biographies of genius artists – we can trace the desire of writers to comprehend the nature of the artists and sculptors’ genius. The foundation of the concept of genius can be (...) found in Immanuel Kant’s works, which synthesized theories developed previously and influenced the understanding of genius by future generations. The paper analyses the consonance of Kant’s aesthetics with the concept of genius in fictionalized biographies of F. Goya, M. Bashkirtseva, V. van Gogh, P. Gauguin, O. Novakivskyi, K. Bilokur, P. Picasso, V. Tsymbal, S. Karaffa-Korbut and other artists, while focusing on the Ukrainian texts of the 20th–early 21st centuries. The research attempts to single out and analyze elements of conceptualizing the notion of genius in novels, including the concepts of the beautiful and the sublime in art, recognition of genius in society, the gender aspect of genius, the issues of heredity, and others. The representation of the image of genius in visual arts, iconography, and the cult of genius are discussed within an intermedial framework. The article considers the spatial and temporal changes manifested in the virtual form of gamification of existence. The definition of the virtual form of gamification of existence is given. On the basis of included observation, the spatial and temporal transformations of socio-cultural reality are rethought, and the philosophical-anthropological approach makes it possible to establish the dependence of the strategies of individual and group behaviour on the inclusion of game actions in the virtual existence. The analysis of the virtual form of (...) gamification of existence as an event and as a co-being is given. The virtual form of gamification of existence is supported by artificially created events, presented as serious incidents, replaced by new ones for tomorrow. The transformation of the structure of free time is considered, which allows transferring most of the life of a contemporary into leisure. The spatial and temporal model of the virtual form of gamification of human existence visually and mentally dissolves the contemporary in the virtual gaming environment. A contemporary, acting out the events, appears in the form of bricolage, multiple images demonstrating strategies of both personal and group behavior. In the virtual interface, time becomes human-sized, allowing in others to see themselves. The space-time boundaries of the virtual form of gamification of existence negate the authenticity of real life, replacing and displacing it with experimental simulation that forms dependence. Introduction and purpose of the study. The article is focused analyzing the phenomenon of gamification of human being in the context of current changes in digital culture. The author reveals anthropological consequences of this phenomenon. Methods. Methods of scientific research, making it possible to identify and characterize anthropological consequences of digitalization of human being and culture, are philosophical, anthropological and cultural analyses. Scientific novelty of the research. The author describes the virtual form of gamification of human being, presented in digital (...) self-presentation. The author justifies the emergence of a new type of man, Homo mobiludens, for whom virtual reality becomes a simplified form of being, and technical and technological capabilities create the effect of being there. The expanded possibilities of human existence gamification in education and service sector with the beginning of the global Covid-19 pandemic are shown. Conclusions. The gamification of being, combining together managerial, socio-cultural, technological and marketing innovations, streamlines human life risks in a new digital culture. (shrink)

The article is dedicated to the phenomenon of designing future in the paradigm of objective reality. Based on the I. Prigozhin’s conclusions on the process of coherence of separate parts into a whole through the establishment of a common development pace of subsystems and the idea of constructivism that a person comprehends social reality through construction, one of the ways of the process of designing the future via its construction by the “extended self” is described. The concept of “the image (...) of the thing” is analyzed as a tool with which the future is constructed in the space of actual objectivity with elusive meanings. It is shown that in everyday reality we deal with “things in motion” - the moment when a thing exists simultaneously in offline and online environments as a kind of impersonal object that does not have an owner. The mechanism of occurrence of the “metronome effect” in the processes of designing the future is revealed. It is proved that the peculiarity of modern reality lies in the endless variability of the images of the future in the space of impersonal objectivity, when the images of things “without an owner” become a tool for constructing the future. For the first time the article reflects on the essence of digital extensions of a person (extended self) in interaction through images of things as “things-in-motion”, which defines a new sociality and suggests a different view of the processes of communication in social networks. It is revealed that the two conditions in the processes of online communications: “being in touch” and “objectivity of consumption” allow us to explain the essence of the processes of designing the future with the key role of the “extended self”. It is concluded that leveling the boundaries between “public” and “personal” in online communications is an innovation in the processes of constructing images of the future, which today has become part of its awareness processes and thus triggers the emergence of the phenomenon of designing the future. The article is devoted to the consideration the problem of the phenomenon of an unreliable narration in the British intellectual prose of the second half of the twentieth century. The meaning of the words “narrator”, “unreliable narration” is investigated. The unreliable narration is reviewed based on the example of the novel “Rites of Passage” by Golding. It is noted that the aforementioned work has a vibrant didactic component. It has been found that Golding uses a wide range of narrative techniques. (...) The emphasis is made on the critical analysis by other literary scholars of the novel “Rites of Passage” by Golding. The use of narrative strategies in accordance with the scientific classification by Genette is investigated. The markers of unreliability of the narrators are emphasized. Attention is focused on the fact that a high degree of unreliability is based on the limited knowledge of the heroes, direct participation in the events, a problematic system of values. It is noted that the unreliability of narration in the novel “Rites of Passage” by Golding forces the reader to doubt not only the narrator but oneself. The use of the narrative method in the intellectual prose of the British writer Iris Murdoch is investi-gated. It has been found that the novel “The Black Prince” by Iris Murdock is one of the best examples of an unreliable narration. The genre specifics of the novel are emphasized, which combines the forms of the diary, of the memoir and of the confession. In addition, Murdoch creates a narrative strategy, which combines signs of various forms of “I am the narrator” within the framework of one narrative. In addition, “The Black Prince” is a unique model of modern artistic and philosophical metatext genre formation. (shrink)

The article is dedicated to a complex analysis of the “war texts”. Discursive features of the triad “war – author – text” are proposed to be researched through the prism of the holistic linguistic act of communication. Discourse analysis of “war texts” is carried out on the material of works of Oksana Zabuzhko, namely, the collection of essays “And Again I Crawl into the Tank” and “The Longest Journey”. The way the topic of the Russian-Ukrainian war is understood and (...) interpreted in the public intellectual discourse is investigated. Such research gives a possibility to acquire data on how the author presents her/his own activity-in-the[1]world and transfers her/his attitude to the events described. It is reiterated that the topic of the Russian-Ukrainian war can be researched within the boundaries of development of the discourse portrait of language personality, as the author’s texts are the information tracks of public discourse. Models of “war texts” of Oksana Zabuzhko are characterized with the help of three types of meaning: experiential (thematic sphere of communication), interpersonal (meaning of social roles), and textual (characterizes the channel of communication). The sense structure of the corresponding respective texts was scrutinized. That helped to acquire new data about their semiotic models. (shrink)

However, these studies touch upon some aspects of Frank's vision of the Bible, or consider individual works of thinkers written on biblical subjects, such as "Moses," "The Death of Cain," "The Legend of Pilate," etc. Let us try here to show that the work of Ivan Franko demonstrates not only a deep philosophical understanding of (...) the Bible, a new, not dogmatic reading of its ancient stories, but also an objective and scientific analysis of the knowledge about it that has accumulated in its time by world scientific criticism. Opening the round table, I. T. Frolov, editor-in-chief of Voprosy filosofii, stated that discussing problems of this type today, the task lies not so much in emphasizing their general and traditional aspects but in finding a scientific and practical solution to new problems of interaction of man and nature that can now be solved only on a global scale. Furthermore, he observed that discussion of these problems as questions of morality, in terms of pessimistic or optimistic evaluation, is very important (...) but certainly entirely inadequate. Not only social and philosophical but many political conclusions follow from a discussion of problems of interaction between man and nature. Investigation and solution of these problems, which require concrete scientific and practical approaches, may facilitate the development of such policies as peaceful coexistence, strengthening of neighborly treaty relations, and so forth. The Brest Union of 1596 is a topic that has for many centuries aroused wide discussions both in the Ukrainian environment and among those of other cultures interested in the history and modern life of Ukraine. This landmark event in Ukrainian history is assessed from different points of view: from the position of a scientist who tries to be objective and rise above the "malice of the day", a politician who cannot avoid the dictates of a congregation, a church activist (...) who upholds the purity of the faith of adherents of a particular denomination., The “average bread consumer,” who ultimately has to reap its benefits. It is no wonder, then, that the range of assessments is also extremely broad, from unconditional acceptance to the categorical denial of everything related to church union. (shrink)

This research aims, first of all, to establish that Abû Hanîfa's (d. 150/767) positive view on the issue of performing wudû’ with nabîdh of date is correct, and then to reveal Abû Hanîfa's dalîls on this subject. The issue of wudû’ with nabîdh of date is controversial among early Hanafî jurists, and the jurist who expressed a positive opinion on this issue is Abû Hanîfa, the founding imam of the madhhab. The opinion that wudû’ can be performed with nabîdh of (...) date is the strong opinion of Abû Hanîfa mentioned in zâhir al-riwâya. The riwâya reported by Nûh bin Abi Maryam (d. 173/789) stating that Abû Hanîfa reneged on this view is not strong enough to oppose the view in zâhir al-riwâya. For this reason, it is not a correct approach to ignore the view in zâhir al-riwâya based on this riwâya. As a matter of fact, Abû Hanîfa's view of zâhir al-riwâya is conveyed in many of the classical Hanafî texts such as Mukhtasar al-Karkhi and Mukhtasar al-Tahâwî. Although the majority of Hanafî jurists preferred the view of Abû Yûsuf (d. 182/798), a significant group of Hanafî jurists such as Jassâs (d. 370/981), Kâshânî (d. 587/1191) and ‘Aynî (d. 855/1451) He supports Abû Hanîfa's view. Therefore, there are two views on the issue in Hanafî fıqh. In the literature, the dalîls of Abû Hanîfa's view is not available as a whole in a single source, but is scattered in many Hanafî fiqh sources. The Hanafî jurist Jassâs is the one who deals with the mentioned dalîls in the most comprehensive way in his many works. For this reason, the subject was examined by focusing on Jassâs's dalîls. Jassâs' istidlâls regarding the issue of wudû’ with nabîdh of date also mean defending Abû Hanîfa against other Hanafî jurists such as Abu Yusuf and Imâm Muhammad (d. 189/805). Jassâs' insistent attitude on this issue and his passionate counter-answers prove how much he deserves the title of defense. For the relevant determination, Hanafî fiqh classics are centered. Because the jurists who argue that wudû’ can be made with the nabîdh of date are among the Hanafî jurists. Then, the positive and negative approaches of the jurists about the nabîdh of date are given. Starting from the early Hanafî jurists, the views of the sahâbîs, the tâbi'ûn and many later jurists on the subject are included. The approach of the four madhhabs of fiqh is also examined in this section. Then, the istidlâls of Jassâs, which is the main subject of the research, were emphasized. It is seen that Jassâs' istidlâls have three main pillars: âya, hadîth and idjma. As a âya, the 6th âya of the sûra of Mâida, as a hadîth, the hadîth of ‘Abd Allâh bin Mas'ûd (r.a.) and as a idjma, the the sahâbîs idjma tries to showas references. The most controversial dalîl is undoubtedly the hadiths of Ibn Mas'ud (r.a.). Jassâs opposes those who claim that the hadîth is da‘îf and discusses the hadîth with its detailed tarîks and argues that this hadîth is sahîh. (shrink)
